Why use a barrister rather than a solicitor?
Essentially because it is likely to save you money. Previously clients were not allowed to engage the services of a barrister without first instructing a solicitor. If your case needed a barrister you would have to engage a solicitor first, thereby paying for two lawyers rather than just one. The direct access scheme now permits you to go direct to a barrister.
Further savings can be made by directly instructing a barrister, because barristers’ hourly rates are generally less than a solicitor of comparable experience and overheads are significantly reduced as I operate as a sole practitioner. Under the Direct Access scheme you can instruct me to act in relation to individual steps in any process and you only pay for the work that I undertake. You can agree the fee prior to any work being undertaken.
With low overheads and no requirement for a solicitor to be involved, using a direct access barrister can lead to significant time and cost savings.  Barristers are regulated by the Bar Council and are required to adhere at all times to a Code of Conduct (for more information please see www.barstandardsboad.org.uk and www.barcouncil.org.uk)

What is the difference between a barrister and a solicitor?
Less now than in the past.  The professions are gradually breaking down the historical divide that previously categorised barristers as specialist advisers and advocates accessible only via solicitors.
Whilst solicitors are still the legal professionals permitted to conduct litigation (e.g. issue court documents, handle clients’ money), barristers are now permitted to deal directly with the public and many solicitors are permitted to undertake advocacy (for more information see the section on direct access).

Barristers remain independent, objective and trained to advise clients on the strengths and weaknesses of their case. They have specialist knowledge and experience in and out of court, which can make a substantial difference to the outcome of a case.  Early advice can often save clients the cost and worry of an unnecessary trial. A high proportion of civil cases are settled out of court, and instructing a barrister greatly strengthens the client’s hand at negotiation. Even at a trial, a well-argued case and good cross-examination will impress a judge.
